Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Longiflo platform ("Service") operated by Longiflo ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
1. Your Role as a Data Fiduciary
By using Longiflo, you acknowledge that you are acting as a "Data Fiduciary" as defined under India's Digital Personal Data Protection Act, 2023 (DDPA). This means you are solely and entirely responsible for the lawfulness of the personal data you collect and process through our Service.
You agree to:
- Comply with the DDPA: Ensure all your data processing activities via Longiflo comply with the DDPA and any other applicable laws.
- Provide Notice: Provide a clear and accessible privacy notice to your end-users ("Data Principals") before or at the time of data collection, as required by Section 5 of the DDPA.
- Obtain Valid Consent: Obtain consent from Data Principals that is free, specific, informed, unconditional, and unambiguous, as required by Section 6 of the DDPA. You must be able to demonstrate proof of such consent.
- Handle Data Principal Requests: Be solely responsible for receiving and responding to requests from Data Principals to exercise their rights (e.g., access, correction, erasure, grievance redressal). Longiflo provides tools to help you manage and delete data to fulfill these requests.
- Children's Data: You shall not process any personal data of a child (an individual under 18 years of age) without first obtaining verifiable consent from their parent or lawful guardian, as mandated by Section 9 of the DDPA. You shall not undertake any tracking, behavioral monitoring, or targeted advertising directed at children.
2. Our Role as a Data Processor
We act as a "Data Processor" on your behalf. Our obligations are:
- Process on Instruction: We will only process the personal data you collect according to your documented instructions (primarily through your use of the Service) and these Terms.
- Security: We will implement and maintain appropriate technical and organizational security measures to protect the data, as detailed in our Security Statement.
- Confidentiality: We will ensure that our personnel authorized to process the data are bound by confidentiality obligations.
- Breach Notification: In the event of a personal data breach affecting your data, we will notify you without undue delay, enabling you to fulfill your notification obligations to the Data Protection Board of India and affected Data Principals under Section 8(6) of the DDPA.
- Assistance: We will provide reasonable assistance to you in fulfilling your obligations under the DDPA, such as by providing tools for data management and security.
3. Acceptable Use
You agree not to use the Service to:
- Collect, store, or process any information that is illegal, infringes on intellectual property rights, or is otherwise harmful.
- Send spam or unsolicited communications.
- Engage in any activity that is fraudulent, deceptive, or misleading.
- Violate the privacy or data protection rights of any individual.
4. Service Credits and Payments
The use of certain features, such as survey submissions, QR code scans, and voice transcriptions, may be limited by a credit system. You are responsible for purchasing and maintaining sufficient credits for your intended use. All fees are non-refundable.
5. Termination
We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease, and we may, at our discretion, delete all associated data.
6. Disclaimer and Limitation of Liability
The Service is provided "AS IS". We make no warranties, expressed or implied. In no event shall Longiflo be liable for any indirect, incidental, or consequential damages, including any loss of data or profits. Our total liability in any matter arising out of or related to these terms is limited to the amount you paid for the Service in the 12 months preceding the event giving rise to the liability.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
8. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of significant changes. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
